Sen. Lindsey Graham (R-S.C.) announced Wednesday night that he is considering introducing a constitutional amendment that would change existing law to no longer grant citizenship to the children of immigrants born in the United States.

Currently, the 14th Amendment grants citizenship to any child born within the United States.

But with 12 million illegal immigrants living in the United States, Graham said it may be time to restrict the ability of immigrants to have children who become citizens just because they are born within the country.

“I may introduce a constitutional amendment that changes the rules if you have a child here,” Graham said during an interview with Fox News’ Greta Van Susteren. “Birthright citizenship I think is a mistake, that we should change our Constitution and say if you come here illegally and you have a child, that child's automatically not a citizen.”

Asked how intent Graham is on introducing the amendment, the South Carolina Republican responded: “I got to.”

“People come here to have babies,” he said. “They come here to drop a child. It's called "drop and leave." To have a child in America, they cross the border, they go to the emergency room, have a child, and that child's automatically an American citizen. That shouldn't be the case. That attracts people here for all the wrong reasons.”

Graham insisted that he wants to be “fair” and “humane” in dealing with the children of immigrants, but doesn’t want to see an already significant immigration issue become larger.

“I'm a practical guy, but when you go forward, I don't want 20 million more 20 years from now,” he said. “I want to be fair. I want to be humane. We need immigration policy, but it should be on our terms, not someone else's. I don't know how to fix it all. But I do know what makes people mad, that 12 million people came here and there seems to be no system to deal with stopping 20 million 20 years from now.”

For one, the problem has gotten ridiculous, as he said, with people coming across the border illegally to have a U.S. citizen baby (on the taxpayer's dime, as well).

For another, it resonates as a political issue and we are less than 100 days from election day. The Federal government action, and inaction, makes clear that it refuses to enforce immigration law, and will resist with all its power to stop a state from forcing it to do its job in this respect. It is a winning issue. The GOP need do nothing but talk about it for a few months, then they can put it back in storage for the next election cycle.

Currently, the 14th Amendment grants citizenship to any child born within the United States.

This is inaccurate. The child must also be born subject to the jurisdiction of United States law. Children who have immunity to our laws, such as children of foreign diplomats, do not gain U.S. citizenship.

I wonder if this could be handled with a statute giving all unborn children of non U.S. citiznes immunity from our laws, and continuing this immunity for a period of one hour after birth.

That's the only reason I think it is. The anchor baby problem is so old here in CA, it just doesn't seem reasonable that's really is gripe.

But tough economic times highlight areas that otherwise everyone ignore.

It is a winning issue. The GOP need do nothing but talk about it for a few months, then they can put it back in storage for the next election cycle.

I'm not so sure about that, there are many 1st, 2nd & 3rd generation hyphenated American citizens who vote in large numbers.

It is a warmed over Southern strategy. Measures ostensibly aimed at a minority are actually aimed at fanning White prejudice or fear and getting out the White vote. The GOP is not depending on winning the Black or Brown vote. That it aims to divide the people and such division is bad for society is not a major consideration.

Yes, more Divide & Conquer - also the classic war between the "Haves and Have Nots" is being fueled; with an unusually callous ultra wealthy class, who likely spend most of the year in EU or more pleasant climes like the Bahamas - only making it to the states when absolutely necessary.
